I think the 3rd gear is a bad design.
Lugging/clutchless shifts in 4th/5th may have some influence.
The way it's used in 3rd-4th-5th and the diameter of the gear means there's not much meat there for strength and if it drops a tooth the chances it'll hit the crank are very high.
It's not a high failure rate but it's always the 3rd drive gear and is usually catastrophic.
They changed the part number in '08 for the cog...
