I would want a full list of all parts/labor explaining how this is a $5k repair before I approved anything. On the surface it sure seems you are out of the frying pan into the fire - unless you had pistons slamming valves and/or complete engine disassembly how is it so much?
I think it's going to be very hard to prove your bike didn't have this broken tab when it was towed into the first dealer. I am sorry for this experience, I can only imagine the frustration you've been through.
