I think that reason should prevail; as long as someone's splitting responsibly, then it shouldn't be a problem. The only time recently that it would've helped me was heading along the 101 into San Fran, but given my panniers and camping gear, I wasn't about to try slipping between those stopped/slowly moving cars.
Around here, I mostly get ticked by the folks who like to race through the tunnel on the shoulder (too much crap there) and then like to try to avoid the traffic merging from the right - they get pissed at the merging traffic, but the shoulder riders are breaking the traffic laws! Those guys will lose out when they use the shoulder as a third lane - tunnel was built to be expanded later.
