I looked it up also, hard to believe the guy was WEARING the stolen gear and was not arrested. If it was my gear and bike, I would have asked him WTF he was doing by running full speed at him and tackling him. It might not be the best way, but...

One thing I've decided: honesty is generally a good thing, but when dealing with miscreants it's best to lie. Just a little. Now that we know that stealing a HAS to involve starting the engine, include that detail. Be sure to include other relevant details "to the best of your recollection". And if all else fails, remember it's a criminal justice system which favors the criminal and not the victim, so bypass it. I some counties, the guy would have simply... disappeared. (Just kidding on that last, getting carried away).

SAD situation.

Down here, castle doctrine extends to your vehicle, wonder if that extends to two wheels...
Also, you can prevent a felony with deadly force if you choose.

Either way, I'm armed 95% of the time...

The Castle Doctrine in PA does extend to motorcycles the way the laws are written (as always, open to the court's interpretation). The firearms laws as far as carrying says that if you are "on" a motorcycle, you are considered to be "in" a vehicle (the same goes for a horse or bicycle, basically any conveyance of travel). It's generally thought that the Castle Doctrine extends to these conveyances as well.

Well, since we're off topic any way:

First, I'm armed a large percentage of the time too, but this was NOT a situation to pull a gun. And just because you're right doesn't mean you're not in for a huge hastle....

For example, when I was the Deputy Staff Judge Advocate for the Military District of Washington the following situation arose. Female SP4 who lived in Maryland was separated from her Marine Cpl husband. He was stationed at Quantico. He was on restriction to the Base because he had beaten her - a few times. He gets off base, and climbs to the third floor balcony of her apartment. Breaks in with the help of the bayonet he is carrying. She yells at him to get out (while pointing her 5 shot .357 revolver at him), he being a Marine (sorry had to get SOME little jab at the Marines in), tries to rush her. She shoots him. 5 times. Whereupon he dies. She calls 911. The idiot police arrest her. She spends the night in jail and is "returned to military custody" whereupon I order her to go home, chill, come in to work in the morning - or take some leave as she sees fit.

Prince William County prosecutor calls me and asks what we are going to do with her. I allow as how we are going to do nothing, seems like open and shut self defense to me.

He says "But she shot him 5 times!"

I said, "She only had five rounds in the gun."

He was not amused, took it to a Grand Jury! I could not believe it. Anyway after lots more hassle and heartache for her, the Grand Jury refused to return a true bill. But damn!
