It all depends if the issue was with hard parts going bad and having multiple failures then maybe. If this a running issue then the engine may not fix it and and entail a lot of troubleshooting that obviously didn't work before. My personal feeling is that if it was bad enough to be lemoned then its got bad vibes going on and walk away.

This is part of the requirement under Canadian law:
  • 4.3.7. You have tried to resolve the dispute with the Manufacturer (according to the dispute resolution process described in Your warranty booklet or owners manual) and have given not only the Authorized Dealer but also the Manufacturer a reasonable amount of time and opportunity to resolve the problem;
  • 4.3.8. You have allowed the Manufacturer to complete the work that it deems to be required under a recall being made under the Motor Vehicle Safety Act or a Manufacturer initiated service campaign"

So, why wasn't the problem fixed in the usual course of warranty repairs? Was this something that just took BMW time to actually find the source of the problem and develop a fix? Or...?

Does this "brand" your title in your province? Will the title identify a CAMVAP vehicle? This would require a deep discount to you.

By the way, Lemon Laws vary by state and by country. In my state motorcycles under 750 cc are not covered.

Who missed the part of the first post where the engine problems were resolved by fitting a new engine? If that's the only thing that was wrong with the bike, then it's essentially a new machine. Personally. I'd want to see the service records that led up the to the engine being replaced, including all the documentatuion and e-mails that were sent between the mechanic(s), service writer, and the factory rep, before commiting to buy.
