Unformed Legal Roads

Sup!

Anyone have any experience with these? There is one local track I am keen to open that is marked as an unformed legal road, but I have met a bit of resistance from the local.

Next step is to have a word to the local council to see what there thoughts on matters are. Keen for tips from those that have gone through it all before.

Chur!

Taz

Same area but not the track. The track goes through DOC reserve land and some Walking Access Act 2008 overrules other access rights according to the dude I was emailing. Would need a permit and he made it clear I wouldn't get one and sent me some pretty stern info about how pulling out plants (unless they are weeds) is illegal. Awesome. Didn't plan to do that anyway?

Really not sure why but I got a wee bit of a vibe that he didn't like me or bikes

I'm all for treading lightly but I wonder what stern wording they use on those pesky slips that are mildly destructive and walkers that leave their farking rubbish behind and shit right next to the track but can apparently do no wrong.

[/end rant]

I'd lay odds he has a beard, thick lens glasses and wears sandals to work.

There was an issue a few years ago when some guys cut a new MTB track where the Whites bay track now is (or around there I believe). I believe it was on DOC or council land It was going to get quite serious but the guys went back & got rid of the track & grovelled a bit.

This may not be all factual but something did happen like that.

To be honest I prob wouldn't give access to motos either unless they presented as a club or group of responsible elder statemen- i've been riding enough to know that many or prob the majority of off road riders are a pack of boffheads - present company excepted of course.

If in doubt, refer to the owners manual

From what I skimmed over that is pretty much what you're allowed to do anyway

There are some things I already knew in there but two things (one important and one just a consideration thing) I didn't realize were:

"In other words the existence of a legal road will prevail over a
certificate of title even if the road is not shown on or referred to in the
title document."

I kind of just assumed landowners knew they were there and were just being dicks about access (in some cases, in others it's somewhat legit because the tards using them have been dicks) but going from that it's probably been sprung upon a few people sort of unfairly.

The other bit that's important if you don't want to have to beg for to much forgiveness is:

"An unformed road may be included in a walkway with the prior
consent of the territorial local authority in which the road is vested: s 6
New Zealand Walkways Act 1990. Before giving consent, the territorial
local authority has to consult with every owner who has a frontage on
or access to the unformed road. Those owners retain the right to use
as a road the unformed legal road after it is incorporated in a walkway.
However, the public are restricted to using the road as a walkway. The
Minister of Conservation may specify any other conditions of use in
the notice designating the unformed legal road as a walkway."

Definitely have mixed feelings about that, but atleast there is still 'legal' access if walking is your thing.

So at this point I'm going to go nosing at a few places closer to home to see what cool wee tracks are hidden away, and I'm sure I'll find some duds too.

After I've exhausted those I will endeavour to find the best looking DOC woman in the area and try and get some trip permits for a few reserves
Any leads would be greatly appreciated

Cheers for the info everyone. I'm sure there will be a few exploration trips sorted at some stage.

On the TV the other night an old couple in Taupo got a professional arbor....aber...tree bloke in to cut down some dead trees on their property, a neighbor complained and the Council are taking them to court.
The Council Guy said " we have to make an example"
He did not appear to have glasses, sandels or a beard......

A bit of usefull advice my father gave me years ago ‘it doesn’t hurt to act a little dumb sometimes’. Dumb people get away with dumb shit, smart people get away with nothing.

BTW, I sat my first exam towards a business degree today. I’ve got another one tomorrow. Perhaps my dumbness is just an act??? time will tell.
