Same. Stock exhaust and I don't act like an ass. When I do filter by, I'm going slow enough that they could get out and chase me on foot if they so choose.

I'll get a ticket eventually, though. I can just feel it.

It's mainly Highway that's doing the hardcore enforcement so if you stay off the highways you have less likelihood of having a problem. I think most of the regular precinct guys don't care too much though they're still aware of the crackdown so don't be a total ass in their presence.

+1 Split in the city for 5 years... black nighthawk or a green KLR, stock exhausts, fullface helmet, gloves, jacket always. Very conservative splitter, but commuted by bike daily from the bronx and then central brooklyn, so there was plenty of splitting done. Got one warning during BS pull-over-every-bike crackdowns, on surface streets, then a year ago got nailed by some asshole on Essex St for splitting stopped traffic to a light. Wrote me two tickets, which then qualified me for a further $350 penalty from the state of NY for having more than 4 points on my license (even though I have a michigan license), which finally caught up with me and raised my insurance.

Don't think it won't eventually happen to you.

Yes, I have a nice shiny red VFR. Yet the day I got the ticket I was riding my blue DR650. Fully equipped with squid-like 42L Givi topcase and really loud stock exhaust.

The ticket I was given states th offense as "Passing in same lane"
I went back to the spot yesterday to take some pics of where I was pulled over. Does the cop's case hold water?

A HW cop's word in traffic court is practically the law. Of course plead not guilty but you know it all comes down to the $$$ in court. The odds are against us but not impossible.

If you present the photos in court, the cop will probably just state that at the time he stopped you, your vehicle was the only one he observed committing the offense. A photo taken of cars passing in the same lane after the fact won't hold water. Just my opinion after wasting $450 to hire a lawyer to try and fight my 3 tickets -- one for lane-splitting, one for an illegal muffler and one for no mirrors even though I had a left bar-end mirror.

I bought my 02' GSXR 1000 last year with the full Yoshimura exhaust already on it. A friend has an extra full stock exhuast for my bike which he doesn't need and I'm thinking of putting it back to stock and putting back on the stock mirrors as well. But, I don't lane-split anymore, so if they ticket me again, it will be just for equipment violations. I haven't ridden in the city much lately, but I still have to go down into Manhattan for some clients now and again. If I only had a Harley-Davidson with straight pipes...

Here is the NYS Vehicle & Traffic law code for mirrors.

10. It shall be unlawful after July first, nineteen hundred sixty-sev-
en to operate on any public highway in this state any motorcycle regis-
tered in this state, unless such motorcycle is equipped with a rear view
mirror which shall be adjusted so that the operator of such motorcycle
shall have a clear view of the road and condition of traffic behind such
motorcycle.

10-a. It shall be unlawful after July first, nineteen hundred sixty-
seven to operate on any public highway in this state any motor vehicle
registered in this state, manufactured or assembled on or after such
date, and designated as a nineteen hundred sixty-eight or later model,
unless such vehicle is equipped with an adjustable side view mirror
which shall be affixed to the left outside of such vehicle and which
shall be adjustable so that the operator of such vehicle may have a
clear view of the road and condition of traffic on the left side and to
the rear of such vehicle.

With Julio's ticket it appears that the argument that others were doing it is not a good idea. It will result with an immediate finding against him. Profiling is not an issue in this case although it may be in a paper stop. The cop observed what he says was a violation. The fact that he only pulled the bike over is not relevant to his defense. It is an admission to the charge. I think his best bet is to say he was not passing he was merging from several to one lane. It is just easier to merge with a bike and it is necessary at times to occupy the same lane at the same time.
Other issues. The muffler issues are addressed by sound level not illegal possession. The law is very exact in terms of the existence of sound. If you can hear the bike at (x) distance from the bike. The questions should be was the bike running and how far it was from the cop. It is a neat piece of cross that a decent lawyer should be able to handle. Although it seldom helps in the NYCDMVKC (kangaroo court.)
Good luck with the tickets. I have a higher success rate with Homicide cases than with traffic violations.
