Call and ask if a title exists, if it does, then drive up to Auburn (about 3 hrs from Boston), and ask him to start the bike. If it runs give him a $100 bill, load it into your pick up truck and bring it home. Seems like a reasonable deal for a running bike?

XT 350s have carb issues both the carbs themselves (Two carbs on a single may have sounded like a good idea at one time) or the mounts/spigots which separate causing a massive air leak. That may be the reason the "gas is running slow" they are pokey if the carbs aren't 100%.

I emailed the guy pointing out his error and he was an ass. Felt like buying it for the $100 and showing up with the EBay legal paperwork and their local sheriff just to piss him off.

His error was listing it as a Buy It Now for $100. It wasn't an auction. Legally, since he said to ignore shipping you could get it for $100. Bet he would put up quite a fuss but it is all there in writing. Cops would make him give it up.

So if you actually go onto the Ebay Auction Select the Add to Cart Function. Then Select shipping and select Free the price of the auction ends up being $100 and you technically could hit the Complete Sale button and the jackass would Legally have to give up the bike thru a Legitimate Auction Sale. He wouldnt be happy but I dont think he could stop it!!

Just click the Buy It Now button and drive to Auburn with $100 in your pocket. Might want to stop by the Auburn Police Dept on your way to grab an escort. ;)

If you hit the buy it now button it will Automatically add in the shipping charges.. its not the same as going thru the steps I outlined above. But your right either way. I would definately stop by the PD and get an escort there!

PD is gonna tell you its a civil matter take it up in court, It's not the buyers bike until the title / registration / bill of sale is in the new buyers name. At least in NY it's that way

Yeah.. Not a criminal matter. In fact, barely even a civil matter. EBay will penalize him, though.... maybe.
