the story states it was rear ended

notice that the rear wheel and swingarm appear untouched.

I think he was rear ended by the ground after he couldn't hang on to the balance point.

The swing arm looks true but I can't tell from the pic if it is...but I bet you the frame is bent or warped and so will result in a total loss from the insurance company. In fact I think it looks snapped into two pieces...?
That's what happened to mine...the rear passenger footpegs on the 05 models are a part of the subframe and when they touched-down onto the pavement after I was cut off by a tractor trailor they (the rear foot pegs) ended up warping the frame slightly. Other than that my Tiger (after having been dragged for about 20 ft underneath the truck) was still ok.

Was the rider injured...? Thrown from the bike...?

Other than the dangling pipe isn't that the normal angle of the rear end of the Tiger?
