Serious question is that what the law says in NJ? Or is it just the way you interpet it? Cause in NY we dont have the "your own property rule"

Quote:
5. "Enter or remain unlawfully." A person "enters or remains
unlawfully" in or upon premises when he is not licensed or privileged to
do so. A person who, regardless of his intent, enters or remains in or
upon premises which are at the time open to the public does so with
license and privilege unless he defies a lawful order not to enter or
remain, personally communicated to him by the owner of such premises or
other authorized person. A license or privilege to enter or remain in a
building which is only partly open to the public is not a license or
privilege to enter or remain in that part of the building which is not
open to the public. A person who enters or remains upon unimproved and
apparently unused land, which is neither fenced nor otherwise enclosed
in a manner designed to exclude intruders, does so with license and
privilege unless notice against trespass is personally communicated to
him by the owner of such land or other authorized person, or unless such
notice is given by posting in a conspicuous manner
. A person who enters
or remains in or about a school building without written permission from
someone authorized to issue such permission or without a legitimate
reason which includes a relationship involving custody of or
responsibility for a pupil or student enrolled in the school or without
legitimate business or a purpose relating to the operation of the school
does so without license and privilege.
Blatant trespass posted on an internt forum is very poor form

Kenny, with all due respect, though you don't deserve any, I have pointed out one of the loopholes in the trespass law as I understand it. Are you a lawyer, or do you just get your information from youtube videos in the wee hours of the night? Really, don't you have to get ready for LB? When are we meeting there again?

p.s., Don't you have your own wannabee game you can screw up? I think it is on page 4.

Can you ever answer a question asked, Or do you just make failed attempts at trying to sound intteligent.?

Is there an actual exclusion to NJ trespass law regarding retrieving your own property. How does it apply to say you for example when you dropped the tag there. Is there an I need to deposit my property on your property exception.

Im I a lawyer? No. But I can tell you I never failed the bar exam.

Now can you point me to your loop hole or does it just exist in your mind?

Anyway, it's kinda BS about the no trespassing signs. If I rode a ways to get the tag and saw them, I'd be upset about it - but I'd probably risk it as you did too. If you have to pass signs that say "no trespassing" it means stay the fuck out. No matter how old or obscure they may be. Sounds like they were clearly visible. Lets just try to be more careful. Sounds like it was a good ride anyway.

Kenny, I'd love to answer any question you have about the law, but this is not the proper place. If you are serious about your question, and aren't doing it just to disrupt and tarnish the game, then I will work with you.

Send me a P.M., and I will be glad to help you understand the issues involved with "trespass", which is one of the more interesting subjects in tort, going back to the origins of the law.

p.s., where are we meeting in Lake George? You buying me a beer?

Yes Doc it was a serious question. I wanted to know if the law had an exception. It appears it doesnt. Im not looking for a defense after I get arrested. And not that I owe you an explanation but the only reason I asked is if I ever run into posted property in NJ on one of these tags I wanted to know what constituted an offense. I will not pass into an area that is posted No Trespassing unless I know the owner or am with somebody who has permission. I feel it is disrespectful to other people's property and not the way to promote a game/sport or whatever you want to call it

If I just wanted to disrupt the game I would resort to calling you names and posting you tube videos of douchebags.

Cmon up ill get you shit faced but Im not arranging for your safe transportation home

And again, I didn't see the "No Trespass" signs. If I did, I would have respected them. Or asked the lady in the driveway with her kids if it was O.K. As it was, she didn't wave me off or ask me to stop. I took that as a license to proceed.

oh no. do not fuck the bullshit. no trespass signs. isn't this about legal drops? wtf. i'm happy doc found "dirt" to ride within 10 miles of the ESB. but still; let's be real? a trail that is dirt with an uphill climb within 10 miles of the city? every husaberg owning girly-boy within 30 miles would be roosting every chance they can on said piece of drit.

let's call it like it is. doc found a great little stretch of dirt. on a questionable piece of land. bottom line.

great that everyone skated with no "5-0" involvement. but frankly, legal dirt within' 10 miles of the ESB? someone riding in their kids sandbox maybe.

carry the fuck on.

First,,, sorry Chris,, I was going to stay out of this but Doc's answer affects everyone who plays this game.

Doc,,, do you actually have a legal precedence for this loophole?? If sowhy take it to PM's,,, it affects all of us. I'm pretty sure it's not some HIPA violation.

And WMAKO,,,, CX500,,, old school cool!! Post up the new tag so we can moving again.

Please P.M. me if you are really interested. Bill, drop a tag so that we can get back to the fun. Hopefully, you didn't get the tag to stall the game.

Loph, we all know there are much better dirt venues in upstate NY, Conn, Mass, Vt., etc. The uniqueness of this particular game is to find some neat oasis of dirt relatively close to NYC. All meant in fun. We are not criminals. We are people with motorcycles looking for Adventure!

If you want endless hours of dirt, you need to do enduros or organized Dual Sport events. Like the Durty Dabbers we did this past weekend. But between work and family, it's fun to find a little neat spot like Rob's tunnel to figure out and explore. You probably could find one even in Queens!

Enough twittering. If anyone has a serious question about the legality of any tags, P.M. is the proper venue. Or, consult your own attorney!
