Stood out in the field in full sunshine yesterday watching the storms break to the north and south. After watching the news this morning I'm feeling pretty lucky to have just been without power for a few hours. Hope you guys all fared as well.

Hypothetical question:
If you were not aware that you were trespassing, (no signs in the area of riding or trail head) and then had a run in with a man dressed in camo, who never addressed himself as LEO, grabbed a hold of your handlebars mid-hill, and was only ever an intimidating man with a gun, who then wrote you a ticket for "Operating an ORV without Land Owner Permission", even though you were on a street legal motorcycle.

What would you do?

I would have made him identify himself as an leo via badge or id. I would have then asked him to send a uniformed car cause you dont believe him to be a pi..cop. Id then print off a map of where you were on google maps and take it to court.

Were you in motion when he grabbed your handlebars? Did he have his badge displayed on him anywhere? Was he by himself or with another officer? Did he radio anything in?

This is the woret time of the year to trespass on a bike . Gun season started last weekend for deer hunting and the dnr are all over the placr trying to catch illegal hunters/trespassers. I would stay out of the woods from October to Christmas if it was me. Especially the month of November.

No kidding!....and whatever you do, stay clear of any woods near Wheeler Hollow Rd. down near the Muscatatuck River or anywhere around the Fort Ritner area, for that matter! Those crazy bastids will shoot you in the back!

Uniform and badge; marked police vehicle
Sec. 2. A law enforcement officer may not arrest or issue a traffic information and summons to a person for a violation of an Indiana law regulating the use and operation of a motor vehicle on an Indiana highway or an ordinance of a city or town regulating the use and operation of a motor vehicle on an Indiana highway unless at the time of the arrest the officer is:
(1) wearing a distinctive uniform and a badge of authority; or
(2) operating a motor vehicle that is clearly marked as a police vehicle;
that will clearly show the officer or the officer's vehicle to casual observations to be an officer or a police vehicle. This section does not apply to an officer making an arrest when there is a uniformed officer present at the time of the arrest.

I believe location is the main issue hear....I would bet there is an exception for the uniform but you should ask to see some ID or let us see a copy of the ticket. The statue listed by Nick applies to public roads but, and not sure, so but DNR is allowed a broad stroke on state land during hunting season and ignorance of the law(or not knowing it was trespassing) is not an excuse. I don't support how he acted only playing devil's advocate before you go to court and it get's worse.

street legal wouldn't matter off road and if the land owner gave permission to DNR because of problems with trespassing.

Thats what I texted him. I told him to verify that it was a real co and then decide from there. if it was then obviously the land owners do not want anyone on their property.
