Wow Devin, I'm so sorry to hear about your loss. I hit a mini-van that turned left in front of me a few years ago but survived with a broken back, torn up knee, and a few broken teeth. I know that nothing I say will really help much but just know that you and your family are in our thoughts.

80-year-old woman charged in motorcyclist's death
Posted: 4:43 p.m. today

Police on Friday charged an 80-year-old woman in the death of a motorcyclist in Cary last month.

Doris Yates Upchurch, of Carpenter Upchurch Road, was charged with misdemeanor death by vehicle and failure to yield right-of-way in connection with an Aug. 24 collision that killed Tomoichi Martin Cummings.

Cummings, 54, was northbound on Davis Drive when Upchurch's southbound SUV turned left onto Waldo Rood Boulevard in front of Cummings' motorcycle, police said.

Upchurch wasn't injured in the wreck.

Thanks everyone for the kind words. I turned the news on last night and just happened to catch that it was now public that the Cary Police have charged the lady who did this.

It gets me though I got the link to the article and there are post about how this woman has money. It bugs me because we are not after money. My father Tomo Cummings was killed on his way to work. This woman broke the law, and I guess because she is a little old lady people want to let her off. Now I have not been a saint in the past and when I have been given tickets I took the punishment. I am a firm believer in "you do the crime, you pay the time". To me these people must not realize that nothing is going to replace my father. I don't care if I had all the money in the world I would give it all away just to have another day, hell another hour with my father. Again sorry for the rant I know you guys seem to understand, thanks for the support.

Prayers sent. A lot of 80-year-old people are half blind or have diminished ability to do things like operating motor vehicles. I hope she is held responsible for his death.

I wish you and your family the greatest comfort possible under the circumstances.

I'm also glad to see criminal charges being pressed. People need to realize when they are behind the wheel that an instant of inattention or negligence can kill someone. Still, I can only imagine what it would feel like to be in that lady's shoes.

You have my deepest condolences.
