Gee, the windshield of the van is cracked... looks like the helmet hit it?

I'm sure the woman in the van is an emotional mess. It's never easy to know that you almost killed someone by driving while distracted (messing with the radio, yelling the kids in the back, talking/texting on the cell-phone...) She is clearly at fault in this accident, but she is not the enemy.

There are no winners in this situation... except for the lawyers. Even as I wrote the previous advice to seek a lawyer and have them write a letter or two for you to the insurance company for a small fee ($100), I DO NOT encourage you to go to retain one by signing a contract of representation unless you really feel ripped off by the insurance company adjusters or if she freaks and hires a lawyer of her own to try to squirm out of her responsibilities.

Keep a level head and take a wide perspective about this situation. Going to court is a nasty and long-drawn out torture for both parties. Have pity on yourself for needing to piece your life together and be in recovery. Have pity on her for not torturing her with the details of almost having killed someone.

It wouldn't be far from the truth to say that you've been given a second lease on life. Especially true that you are still walking and talking after such a serious accident. Many people who go through similar realizations go on to do great things for they've seen that their time on this Earth is limited.

Do not take this "gift" lightly and return to your everyday dulldrums nor the old mentality of strictly "me & mine".

You will notice that I seem to be contradicting myself. I'm merely the pointing out an option C, if we were only talking about A and B up to now.

Just seen this today. Holy crap bud from the looks of the bike you are one lucky man.Glad you are alright. Hope you have a full recovery and no future problems from it.
Hope you don't give up riding. I'm sure once the spring comes you will get the urge to ride again. Once a motorcyclist always a motorcyclist. Plus you can't give up riding, i'll have no one to ride with again. It's hard to find people that ride dual-sport bikes in this area. All people ride around here are those loud harleys. LOL
