If that is the case...then there is no big deal that means other examples thrive...LOL

No, but I'm had to stop on Tyvek sheeting and have someone else fuel my bike during an enduro because I couldn't be trusted to protect the environment myself!

We all need to realize this situation has absolutely nothing, NOTHING to do with a few trout in a stream and everything to do with eliminating the easiest to eliminate user group first. The mountain bikers, which I am one, need to watch out if we (motorcyclists) get permanently banned because they're next!

I think it's pretty obvious that the real issue here isn't the fish at all. It's all about an anti-OHV group that found a good excuse to file a lawsuit. If they were really only interested in protecting the fish, they would sue to have the trail closed to all use.

Fines

Just out of curiosity, does anyone have any experience with the going rates for fines if caught riding on closed/illegal trails?

It's not even that honourable. The CBD are not misguided idealists, they're a group of 20 or so money grubbing shitbag attorneys that have discovered a rather lucrative way to exploit the Endangered Species Act and leach millions in public tax dollars for personal profit.

Since this really isn't about the fish, maybe we could get the ACLU involved for a discrimination lawsuit.

Well, I sure hope it wasn't the motorcycles keeping the fish alive. Who's to say pools weren't forming because of dirt/scree washing into the creek? Oh, that must be why they're still allowing everyone else to use the trail.

I think the fact that moto users have been the only ones to accually do anything to help(building numorous bridges) while everyone else just complains would go a long ways in a federal court. The judge will see that we have been trying to help the situation by dedicating time/materials(OHV funds!) and trying to get a reroute(thats works for everyone) while other user groups are just trying to single us out and still use the same defective trail system(which doesnt help the fish). A judge has to respect the truth when it is presented to them properly.

side note- might be able to ride it on monday . . .

Yes along with it's partnership organization the TPA. For this particular fight TPA is taking the lead.

I know nobody wants to hear this and I hope it does not start a pissing match.

But here we have yet another lawsuit to deal with, and that costs money.

Both the TPA http://coloradotpa.org and COHVCO http://COHVCO.org NEEEEEED help financially. Those that will see us gone from the woods have MUCH deeper pockets.

We belong to a group that will spend $100 on a tire and much more on "farkles" but usually won't send a lot to these organizations.

I'll say it again, there are over 150,000 registered OHV in Colorado and less than 3,000 COHVCO members.

It's estimated that we'll need at least 100k just to fight the lawsuits that are underway right now....so if you do the math, it does not add up.

It's a big deal. You can get a trip to federal court if it is on national forest.

Thanks Rod for bringing up the ugly truth. I challenge everyone on the thread to give back and support TPA with a significant contribution.
