Local Accident from June

I rode by this accident site shortly after it occurred in June. I'm sorry for all the people involved.

What struck me is that driver was charged on one count of 'Careless Driving Resulting in Death' and received a one year sentence.

This article presents one version of the events so far.

http://www.dailycamera.com/louisvill...ed-2-sentenced
Driver in Louisville head-on collision that killed 2 sentenced to 1 year in jail.

The driver of an SUV that was involved in a head-on collision in Louisville that killed a father and his daughter and seriously injured another child was sentenced to one year in jail after accepting a plea deal Friday.

Cassie Tafoya, 25, pleaded guilty to one count of careless driving resulting in death, a Class 1 misdemeanor. As part of the plea bargain, prosecutors dropped another charge of careless driving resulting in death as well as a charge of careless driving resulting in serious bodily injury.

Ocatvio De La Torres-Reyes, 37, of Northglenn, and his daughter, Leslie DeLaTorre, 14, of Westminster, both were killed after Tafoya's Lexus SUV collided with the Toyota pickup driven by De La Torres-Reyes on June 27 in the 8900 block of Dillon Road.

De La Torres-Reyes' son, who was 6 at the time of the accident, was also seriously injured and remains in a wheelchair.

According to Louisville police, Tafoya told officers at the scene that she had been using or reaching for a phone when she drifted into the other lane and hit the pickup truck. Police also believe none of the three people in the pickup truck were wearing a seat belt.

The driver killed a daughter and father and left the son disfigured and in a wheel-chair...and she got a 1 year sentence and will probably get out in 6 months on good behavior. It is no doubt unfortunate, but don't forget there probably is/was a hefty civil suit.

At least she is getting jail time, there was a time when not even that was possible.

The odds of a 25 year old having enough assets or insurance to pay for two deaths and the severe injuries of a boy are virtually non-existent. Speaking of your debt, if the boy's limitations are permanent and severe, odds are he will require substantial Medicaid/ssi money for the rest of his life.

None of the three in the pickup were wearing seat belts? Likely the main reason they are dead.

Who's fault is that?

25 yr old.. Lexus SUV? Sounds like daddy has some spare change. Hopefully it goes to helping the 6 year old.

If the father hadn't died in the accident then he should be sitting in jail as well for not buckling in his kids. That 6 yr old should still be in a booster or big car seat.

All of the blame rests on the person who caused the accident. Seat belts are not at issue here, any more than victims of any other crime are to blame for their deaths/injuries. Dangerous driving is the cause, and innocent people are dead due to a young woman's cellphone conversation being more important to her, than the lives of the human beings whom she killed.

I dunno, but if you give this thread enough time I'm sure someone will blame it on the Tea Party.

It's time for some cell phone control. I mean, what kind of crazies are getting cell phones these days?

Background checks. That'll fix it.

Or a ban on military "style" cell phones.

Or limit cell phones to have no more than 10 minute battery capacity.

I just mentioned the civil suit because the punishment isn't necessarily over for the driver at fault.

I didn't say "justice will be served"...if you knew me you'd know I'd rarely say something like that. Who cares whether she is poor or loaded, nothing's even going to bring the daughter and father back to life and give the son a regular boy's body back.
