Clever idea.

But I'm betting a place like described is a mostly "cash under the table" kind of place.

Yes, I meant I only had liability on it, not collision. Still no luck on the Sherrif's dept finding it. I'll update here when there is some resolution.

For god's sake, don't start out by filing a lawsuit against the shop. Go talk to them, let them know that you both understand that it's legally their resposibility (subtly), that the car wasn't worth much, but you need something to drive around, and they should do something- maybe give you $500 (split the value of the car), maybe hook you up doing work on the next beater car you find. Starting out by putting a lien on small shop is no way to live, IMHO.

I can see where that sucks though. I mean, I drive a piece of shit. But it's a currently well running piece of shit because I fix what doesn't work, and the mysteries are solved. I wouldn't get anything for it in the event someone hit me, and even less if someone stole it since I don't even insure it for that, but I couldn't replace it for a fair amount of money. Any other POS I bought would have to be gone over again, and probably have the purchase price put into it in parts, and then it's still an unknown.

Talking out my ass a bit on this, but here goes.
When my friends F250 was stolen out of his driveway one week after he made the last payment, the insurance company asked for the most recent service records. We presumed they wanted to make sure the claim wasn't a fraudulent one designed to get my friend out of a huge repair bill or something.

For A car that old at a shop with a bad transmission is not worth filing a report. At the end of the day you had a parts car at best. Your insurance company will probably feel the same. Work out something with the shop. Maybe ask him for some free labor or a ppi for the next car you buy. Just realize that a meth head thief is the bad guy here. Sometimes we lose to these jackasses and no amount of squirming and trying to get someone else to pay for our loss will change that.

Cops found it.

The meth heads left in a ditch in Johnson County TN, the sheriff's dept says it has been spray painted black and green, I can't wait to see this. Going over there to get it Thursday (hopefully it is drivable) so I will be sure to post up a pic for y'alls general amusement.

So now the question is....is the shop liable for the theft and subsequent damage to property?

I think yes, but not an expert by any means. What say you?

Well at least you got a paint job out of the deal.

You may want to carefully check to make sure there aren't any needles hidden in the car. You don't want to find one with a bare hand some day.

The good news is that you've probably got a far greater chance of getting them to do some work on the car for free, as payment for allowing it to get stolen while in their care, custody and control than you ever did in getting them to pay you for your loss if it hadn't turned up. Maybe they do what it was in there for and get the a/c working in the bargain. Maybe they know a guy who paints cars who'd trade for whatever it is that they do as well.

Bad news is, if it was meth heads...you're going to need a new catalytic converter.

Bluhduh Pics as promised.

The car was originally gold. A friend of mine has named it in its current condition "The blue leapord."
