UT Criminal Mischief Laws

Class B misdemeanor Criminal Mischief
The offense you are charged with may be considered a Class B misdemeanor if the action recklessly endangers human health or safety or if the value of damage is less than $300. Class B misdemeanors are punishable by up to 6 months in jail and fines reaching $1,000.

Class A Misdemeanor Criminal Mischief
Your criminal mischief charge could be a Class A misdemeanor if the act recklessly endangers human life or the damage is valued at between $300 and $1,000.

Class A misdemeanors carry a potential sentence of up to 1 year in jail and fines of $2,500.

Third Degree Felony Criminal Mischief
You could face a 3rd degree felony charge if the damage caused by the act is valued at between $1,000 and $5,000. This classification of felonies is punishable by up to 5 years in prison and fines of $5,000.

Second Degree Felony Criminal Mischief
Criminal mischief is charged as a 2nd degree felony if it recklessly causes or threatens to cause a substantial interruption or impairment of a critical infrastructure or if the damage caused in the commission of the offense is valued at more than $5,000.

A 2nd degree felony can carry a potential penalty of 1 to 15 years in prison and fines reaching $10,000.

Hey its the law, and this formation alone could be valued at over $5,000. People pay good money for rocks, they also pay really good money for unique art that is one of a kind which this is art. People come and pay to see Goblin Valley do to the formations. Knock down all the formations (destroying art) then it's worth is very little to the State and the Park system.

I'm just sick of people actually saying it don't matter.

Then maybe I will come onto your yard and cut down that odd leaning tree because after all it "might" be unsafe. Never mind I'm not a professional in any way to make that call but hey I determined it is so it's coming down. Would you not want me prosecuted? Surely you would laugh at my defense of "It was for the kids".

You do not have the RIGHT to determine what is safe or unsafe.

What's next going to Garden of The Gods and pushing the balance rock over after all it LOOKS unsafe to ME.

Glenn Taylor should get the heaviest charge, he was dumb enough to do the crime. I would say Dave Hall filming and egging him on should get the next charge and for Dylan Taylor the son of Glenn Taylor I'm not sure he did much more then look the clown and needing a fashion intervention.

So yes for sure Glenn needs charged with at least 3rd degree Criminal Mischief. I'm still worried why someone here would be so worried about this guy being charged with a felony and whether he can own guns or vote...oh well don't be stupid then and loose your rights.

Most likely they will be charged with:
76-6-106. Criminal mischief.

76-6-206 (Effective 07/01/14). Criminal trespass.
(i) intends to cause annoyance or injury to any person or damage to any property, including the use of graffiti as defined in Section 76-6-107

76-6-206.2. Criminal trespass on state park lands -- Penalties.
(5) In addition to restitution, as provided in Section 76-3-201, a person who commits any act described in Subsection (2) may also be liable for civil damages in the amount of three times the value of:
(a) damages resulting from a violation of Subsection (2);
(b) the water, mineral, vegetation, improvement, or structure on state park lands that is removed, destroyed, used, or consumed without authorization;
(c) the historical, prehistorical, archaeological, or paleontological resource on state park lands that is removed, destroyed, used, or consumed without authorization;

This is right up with the idiots that shot up the petroglyphs a while back. I'm not sure it rises to the level of a felony, but it is definitely a crime. Stupid should be painful, and expensive.

These types, as with any "types", don't just pop out of the ground. They are a product of our society, a part of it at least. Do a majority of Americans give three-quarters of a flying f$%& about this sort of behavior? "No one got hurt, it's a rock and some dirt"...I'm not justifying it, but that what many others are probably saying especially these d-bags' friends and family.

Did this even make the local news? That'd be telling.
